Find out what&#8217;s involved in these decisions and if you&#8217;re affected.<\/em><\/center><\/figcaption><\/figure>\n<h2 class=\"p1\"><b>House Bill 6 Repeal Means Cash Back for Some<\/b><\/h2>\n<p class=\"p2\">Back in December, we warned that House Bill 6 could bring you\u00a0<span class=\"s1\"><a href=\"https:\/\/www.ohenergyratings.com\/blog\/dayton-customers-higher-electricity-rates\/\">higher electric rates<\/a>. <\/span>House Bill 6, or the \u201cOhio Clean Air Program\u201d, included bailouts for two nuclear power plants then owned by\u00a0<strong><a href=\"https:\/\/www.ohenergyratings.com\/companies\/energy-harbor\"><span class=\"s1\">First Energy<\/span><\/a><\/strong>. Since then, allegations of <a href=\"https:\/\/www.cleveland.com\/news\/g66l-2019\/05\/ce7f1b02ee6954\/nuclear-bailout-bill-shows-how-big-money-can-be-put-to-work-in-the-ohio-statehouse.html\"><span class=\"s1\">racketeering, bribery, and corruption<\/span><\/a>\u00a0have cast a shadow on the law.\u00a0Now, the newly passed House Bill 128 has repealed part of that law including a decoupling provision. The repeal comes after\u00a0<strong>First Energy<\/strong> announced refunds to their customers.<\/p>\n<h3 class=\"p3\"><span class=\"s2\">What Is Decoupling?<\/span><\/h3>\n<p class=\"p2\">Apart from the fees for the two nuclear power plants, House Bill 6 also included a <a href=\"https:\/\/www.cleveland.com\/open\/2020\/12\/heres-what-hb6s-controversial-decoupling-policy-is-and-why-ohio-lawmakers-are-trying-to-repeal-it.html\">&#8220;decoupling&#8221; provision<\/a>. \u00a0This section provided\u00a0<strong>First Energy<\/strong>\u00a0with a yearly income and a way to make back lost income from energy-efficiency programs.\u00a0Decoupling is a common way for utilities to make up some lost income. However, House Bill 6 helped <strong>First Energy<\/strong> make more money in 2018 than in other recent years. About\u00a0$<span class=\"s1\">355<\/span>\u00a0million, in fact.<\/p>\n<p class=\"p2\">As a result, <strong>First Energy<\/strong>\u00a0utilities,\u00a0<strong><a href=\"https:\/\/www.ohenergyratings.com\/companies\/toledo-edison\"><span class=\"s1\">Toledo Edison<\/span><\/a><\/strong>, <strong><a href=\"https:\/\/www.ohenergyratings.com\/companies\/ohio-edison\"><span class=\"s1\">Ohio Edison<\/span><\/a><\/strong>, and <strong><a href=\"https:\/\/www.ohenergyratings.com\/companies\/illuminating-company\"><span class=\"s1\">The Illuminating Company<\/span><\/a><\/strong>\u00a0charged customers higher rates than all other utilities in Ohio.\u00a0What&#8217;s more is that House Bill 6 set these payments to last through 2024. That means\u00a0<strong>First Energy<\/strong> could have made an\u00a0<span class=\"s1\">estimated $978 million each year<\/span>.<\/p>\n<h3 class=\"p3\"><span class=\"s2\">How Much House Bill 6 Remains?<\/span><\/h3>\n<p class=\"p4\">The monthly utility bill fees to support <strong>First Energy&#8217;s<\/strong> two\u00a0nuclear plants went to a \u201cNuclear Energy Resource Fund\u201d. The fund would have collected\u00a0<a href=\"https:\/\/search-prod.lis.state.oh.us\/solarapi\/v1\/general_assembly_134\/bills\/hb128\/EN\/05?format=pdf\"><span class=\"s3\">$150 million annually until the end of 2027<\/span><\/a>. After the corruption scandal, Ohio passed House Bill 128 in March to scrap much of that 2019 law.\u00a0However, several provisions from that law remain in force. These include the Ohio Clean Air Program and the Solar Energy Credit Fund to help expand solar energy in Ohio.<\/p>\n<h3 class=\"p3\">Who Gets Refunds?<\/h3>\n<p class=\"p2\"><strong>First Energy<\/strong> stated in its press release that it would &#8220;<a href=\"https:\/\/www.firstenergycorp.com\/newsroom\/news_articles\/firstenergy-s-ohio-utilities-to-return-previously-collected-deco.html\">collectively credit customers<\/a>&#8221; for the funds it\u00a0collected. All told, that adds up to\u00a0$26 million from about 2 million of its utility customers.\u00a0Unfortunately, <strong>First Energy<\/strong>\u00a0has not announced the refund amount.\u00a0A rough calculation suggests that each of its customers could get <a href=\"https:\/\/www.beaconjournal.com\/story\/news\/2021\/03\/31\/akron-based-firstenergy-return-16-million-ohio-customers\/4825434001\/\"><span class=\"s1\">approximately $13<\/span><\/a>.\u00a0\u00a0The company has not said when customers will see it.<\/p>\n<h3 class=\"p6\"><span class=\"s2\">What Does This Mean For The Rest Of Ohio?<\/span><\/h3>\n<p class=\"p7\">Decoupling isn\u2019t a new idea for Ohio, or <strong>First Energy<\/strong>. With House Bill 6 fading, Ohioans will still need to find the best way to maintain the state&#8217;s grid.
